Zoya Sues Julep - Not Once, But Twice?


So the other day I was thinking about my "Lindsay Lohan giving the judge an F U" blog logo. And it was actually in response to a lawsuit Zoya filed against Julep back in 2011. I realized I had never ever heard the result of the lawsuit. What happened? So off to facebook and google I went.

So to recap, the original lawsuit was filed in August of 2011 Siting some common blogs as proof of their case.




But what exactly WAS their case? Why were they suing?

This is a trademark infringement case. Plaintiffs filed their complaint on August 15, 2011 asserting four causes of action: (1) federal unfair competition under the Lanham Trademark Act, 15 U.S.C. § 1125(a)(1)(A); (2) violation of Ohio’s Deceptive Trade Practices Act, Ohio Revised Code § 4165.01 et seq.; common law unfair competition; and unjust enrichment.
From court documents I found its basically, Julep uses girls names just like Zoya does. Cut and paste from court documents:

Plaintiffs are an Ohio-based cosmetics company that started 25 years ago here in Cleveland.1 Their company sells nail polish, and their marketing strategy involves branding nail polish colors with distinctive female names. For instance, a nail polish of a certain red hue is named “Salma,” while a nail polish of another hue is named “Gweneth.” Defendant, a corporation whose principal place of business is Seattle, Washington, also sells nail polish. Like Plaintiffs, Defendant assigns female names to its different nail polish colors.

In a Motion to dismiss for lack of jurisdiction filed in November of 2011 by Julep they claimed many things including the fact that their presence in Ohio was not enough to warrant the claims and others, but ultimately the motion to dismiss was denied. You can find the motion and results HERE. Julep appealed the decision to deny the motion but that too was denied. In December Julep asked for a jury trial, though ultimately that never happened. In January of 2012 both parties came to an agreement agreeing to dismiss the case with prejudice and with each side agreeing to cover their own incurred legal expenses. In April of 2012 though Zoya filed a motion to enforce the settlement but before they could argue the motion in front of a judge it seems the issues was settled by way of a settlement conference so they withdrew the enforcement request. From what I can gather from the documents I have seen (which is very few) it seems the issue was a list of names that it seems was agreed to be off limit for Julep to use. In May of 2012 the agreement was signed (SOURCE).

This is where the story should end, but it seems that this past October Zoya once more petitioned the courts to enforce the agreement. This motion was denied and in December (3 months ago) Zoya filed a new lawsuit with the Cuyahoga County Clerk of Courts. 3 weeks ago though, the suit was transferred to the United States District Court. As for this current lawsuit, it was just transferred to the US District Court on January 21st of this year. It seems from my understanding that this lawsuit is specifically about enforcing the previous lawsuits settlement agreement. I am not a lawyer, but I would think if you motioned to have a judge enforce it and the judge said no, you couldn't just file a new suit, but I guess I am wrong. (SOURCE)

A Little Known Fact About Zoya - Share This With Your Friends And Surprise Them Too!!

We all know Chanel, Dior, Illamasqua, Julep and the like are bottles of polish where you can remove the outer cap to be able to paint your nails without holding on to a big bulky square handle. Same with Butter London (not the really old smaller Butter London bottles though). This is usually not a surprise, though with Julep it seems to surprise some people. 


Well. Guess what? Zoya also!

Zoya Vespa & London Swatched


Last of the new Pixie Dust polishes, I have Vespa and London for you.


Vespa is a pale, muted green that almost has a faded look to it. With silver glitter. Again, this was on the thinner side, and needed three coats to be even and opaque.



London is a medium grey shade. Fairly neutral and not blue leaning like many greys. it was opaque in two coats and a dream to work with. Seems like this is how all the pixie dusts were. Half of them were great, and half were on the thinner, patchier side. Overall, this and sunshine are my two favourites.



Zoya Nyx & Dhara Swatches


Next up are Zoya Pixie Dusts in Nyx and Dhara.


Nyx is a light, muted purple leaning blue with silver. Gorgeous on, but very sheer and takes three coats to completely cover. Not what I expect or want from a textured polish such as this. But very pretty.



Zoya Dhara is a fricken awesome bright orange with gold glitter. Opaque in one coat, though two is better, its a polish that really says "look at me!". Also, this would make much more sense to have been called Sunshine. Seriously think Zoya should have swapped names on this one and that one!

Zoya Vega & Sunshine Swatches



Can I just start by saying Sunshine is a stupid name for navy blue polish? I love the polish but sunshine?!!! Thats a yellow, maybe an orange, but a navy? Just wrong.

Vega is from the Pixie Dust collection that was holographic pixie dusts. It was thick and patchy and not fun to work with. This is three coats. A liquid sand/textured polish should NOT take 3 coats to make work. Not happy. The shade however is pretty.



Sunshine. Aside from the stupid name, this was GORGEOUS. It was what I expect of a polish like this. Opaque in one coat, though a second is always helpful. Gorgeous, applies like a dream, and did I mention GORGEOUS?!! LOVE THIS!



Why You Need To Shop At Nail Polish Canada At Least Once

So I recently placed an order on Nail Polish Canada's website. Now I am a bit of a smart ass and I love monkeys. Those are two important things you must understand in order to "get" this post. 

Recently, someone posted in a facebook group I am in a picture of a dinosaur hand drawn with her order from the company. She apparently made a joke in the comment section about  how much she wanted them to draw a picture of a dinosaur. 


And so I put THIS comment on my order. I was seriously NOT expecting a monkey to be drawn, but yeah.....

Birthday Group Gift #3


So I am part of a birthday group. What this is a group of 12 girls (in theory, we only have 10) who each have a birthday "month". My birthday is in May, but June is my month. So every girl sends the birthday a girl a nail polish gift each month for their birthday. Meaning that each of us will get 9 gifts each month with no one in July or December.
